Abbott Falsely Claims His Executive Order Ended Texas Vax Mandates

Earlier this week Abbott tweeted the following:

Abbott’s reasoning appears to be that because the courts have frozen the OSHA, CMS (hospitals), and Federal contractor mandates, that his executive order is no longer superseded by the supremacy clause. He ignores the fact that the court injunctions are temporary. Should the courts ultimately uphold the federal vax mandates, his executive order would again be completely powerless.

More importantly, he neglects to mention that the mandates for legal border crossings, inbound flights, Federal employees, and the military are still in place. This all means that mandates are still in place in Texas. Any inbound international flights landing in Texas are subject to the vax mandates. People legally entering Texas from Mexico are also subject to the mandates (but illegals are exempt). The Texas National Guard is subject to the mandates. And Border Patrol employees are currently being threatened with termination if they do not get the shot, precisely when we can least afford personnel losses due to the lawlessness at the border. Thus, Abbott’s assertion that “ALL of the Biden Administration vaccine mandates have been halted” is demonstrably false.

Furthermore, because Abbott’s order is merely an executive order and was not imposed by the Texas legislature, it only carries the force of law during declared “emergencies.” It is doubtful that Abbott will have the power to forbid private businesses from enforcing vax mandates through a mere executive order once the declared COVID “emergency” is over. His executive order will then likely be found to be unconstitutional or otherwise limited, just as many of the senile tyrant’s diktats. His executive order will then likely only be effective at preventing vax mandates by the state government. If we are lucky, perhaps Abbott will indefinitely extend the “emergency” and the courts will permanently nix the private-sector mandates. That’s a lot of hoping and wishing…

Texans are being forced into getting shots by the tyrant right now. Thus, we can only conclude that Abbott’s order is at best weak, and at worst fake, just as we said back in October. He’s just trying to make it out like he’s doing something. This is why we developed a plan to stop the tyrant’s vax mandates by fully utilizing Texas’ plenary police powers, and which would also castrate the tyrant’s Federal mandates. It’s sad that TxLege has not listened. We may pay the price at the border, when the Border Patrol loses critical staff.
