Above the Law: Untouchable DACA Baby Flexes on America
At the same time your rights and protections under the law are evaporating, some people residing in our country are enjoying levels of legal protection a diplomat’s son would envy.
(JTA) — A Jewish woman who was in ICE custody and was scheduled to be deported has been released following a push by Jewish advocates, immigration activists and local officials.
Nylssa Portillo Moreno, who came to the United States as an undocumented immigrant at age 8 from El Salvador in 1993 and grew up in Houston, was detained in December by Immigration and Customs Enforcement, according to RAICES, a nonprofit that provides legal services on immigration and is representing Portillo. She was originally scheduled to be deported this week
After RAICES tweeted about her case on July 23, a coalition of Jewish advocates sprung to Portillo’s aid.
Ain’t that something?
Although she qualifies for DACA, the program that allows undocumented immigrants who came to the United States as children to remain in the country, she has not applied, according to RAICES. Now, new applications are not being accepted. RAICES also said that Portillo is a cancer survivor, making her more vulnerable to the worst effects of COVID-19, and that she was denied kosher food while in custody. According to RAICES, she lost 60 pounds while in custody.
DACA is a program for whereby infiltrators to our country can continue their ongoing criminal activity as recipients of stolen goods. The argument for not ejecting the DACA Babies is that, because they were brought to the US by their criminal parents when they were young, they should be above the law and continue to reap the benefits of the goods their parents stole in the form of US residency. There is no other crime I’m aware of whereby a criminal can keep stolen goods once caught because they were “young” when they received the stolen goods.
Imagine a serial bank robber robbing 50 banks and collecting hundreds of millions of dollars. The bank robber then buys his family lavish gifts and luxury homes with the stolen money. When the bank robber is finally caught, imagine a judge stepping in and saying “well, you can’t take poor Timmy’s Ferrari F8 Spider, because he received it when he was only 8 years old and his father left it to him.”
This is basically what we are dealing with here. You’d think she would at least be grateful we helped her with her morbid obesity.
On Sunday, Never Again Action, a Jewish group that protests on behalf of immigrants at ICE detention centers, and the progressive group Jews for Racial and Economic Justice organized a phone bank that called ICE asking for her release, in addition to calling friends to raise awareness of her case.
ICE, like all other agencies of the executive branch of the federal government, are supposed to be non-political entities that execute and enforce the laws passed by the Congress. Instead of calling Congress and demanding they change the law, they just called ICE and got what they want.
Talk about privilege.
