Denton, TX: Antifa Man Incites Breach of the Peace at Buc-ee's, Gets Punched
It has famously been said that "my right to swing my fist ends where the other man’s nose begins." A needed modern corollary might be that, "Your right to play indecent, vulgar and hateful lyrics ends where my ears begin."
According to extant Texas Law, if a person "uses abusive, indecent, profane, or vulgar language in a public place, and the language by its very utterance tends to incite an immediate breach of the peace," that person is engaging in disorderly conduct.
This writer is unaware of an exception whereby such language does not constitute disorderly conduct on the basis that a person, rather than utter such words with his own mouth, broadcasts the language, at high volume, on repeat. While incurrious local media report only that Jason Lata punched a counterprotestor after an argument, national media slouthes at TMZ watched and listened to the entire 50 second video clip, and surmised that the Lata was trying to get the man to "stop playing YG's political anthem on repeat."
7:35 AM PT -- 10/4 Jason Lata was arrested on a charge of assault causing bodily injury late Saturday night, according to Denton police. Lata's bail is set at $15,000.
Four weeks before Election Day and the song "F**k Donald Trump" is a serious trigger for at least one Trump supporter, who sucker punched a man over it.
The violence went down outside a Buc-ee's in Denton, TX and the video shows a couple of maskless Trump supporters telling another man to beat it and stop playing YG's political anthem on repeat.
The knee jerk reaction of most goodthinking people is that the punchee had the right to play this political anthem. But the song that was being played was "abusive, indecent, profane, [and] vulgar" and the language used "by its very utterance" incited "an immediate breach of the peace." If the punchee was unsure whether the music was inciting an immediate breach of the peace, two incited men were in his face, explaining this reality to him. Yet he refused to turn off his "abusive, indecent, profane and vulgar" music. He received a punch as his reward.
Should Trump supporters, gathering in solidarity as their leader lays in a hospital bed with Covid-19, be expected to stand politely while this "anthem" is playing? Should children and other gas station customers be exposed to this treasonous and vulgar rhetoric?
Not every act of violence is without justification. There are certain words and actions which are so provocative that we can't punish the provoked. Jason Lata was clearly provoked. He reflexively extended his fist.
